Terms and Conditions for GBM Casting Kids – Scotland

GBM CASTING KIDS is a children’s casting agency operating in accordance with relevant
employment laws, child labour laws, and performance regulations in Scotland, ensuring
compliance with the Children (Performances and Activities) (Scotland) Regulations 2014.
These Terms and Conditions outline the relationship between the agency, child performers,
their parents or legal guardians, and the production companies that hire the children. By
registering with GBM Casting Kids, parents or guardians agree to these Terms and
Conditions on behalf of the child performer.
1. Definitions
– Agency: Refers to GBM CASTING KIDS, a children’s casting agency.
– Child Performer: The minor (under 18 years) registered with the agency for work
in film, television, commercials, or other performances.
– Parent/Guardian: The legal parent or guardian of the child performer who
consents to the child’s registration with the agency.
– Client: Any production company, casting director, or employer seeking to hire
child performers through the agency.
– Work: Any performance, audition, or role offered to the child performer via the
agency.
2. Registration and Right to Work
2.1 The child performer must be legally allowed to work in Scotland, and it is the
responsibility of the parent/guardian to ensure this.
2.2 To register with the agency, the parent/guardian must provide:
– Proof of the child’s date of birth.
– Evidence of the child’s right to work in the UK.
– Contact information of the parent/guardian.
– Relevant performance experience or skills of the child performer.
– A £30.00 Admin fee per annual year the child is represented by GBM Casting Kids
2.3 The parent/guardian must notify the agency immediately if there is any change in the
child’s eligibility to work or any personal details.
3. Agency’s Role
3.1 The agency acts as an intermediary between the child performer and potential clients
(production companies, casting directors, etc.). The agency will endeavor to find suitable
work for the child performer, but no guarantees of work or employment are made.
3.2 The agency will liaise with clients to agree upon terms of work, including working hours,
compensation, and any additional requirements (such as wardrobe or rehearsals).
3.3 The agency will ensure that any client working with child performers is compliant with
Scottish child labour laws and that necessary performance licenses are obtained.
4. Parent/Guardian Responsibilities
4.1 The parent/guardian is responsible for ensuring the child performer’s attendance at any
auditions, fittings, or filming sessions as agreed.
4.2 The parent/guardian must be present or appoint a responsible adult to accompany the
child to any audition, rehearsal, or work session.
4.3 The parent/guardian must keep the agency informed of the child’s availability and any
restrictions that may affect their participation in work.
4.4 The parent/guardian is responsible for providing the necessary documents when
required by law for their child to perform.
5. Casting Process and Availability
5.1 All communication regarding potential work opportunities will be sent to the
parent/guardian via the contact details provided. It is the responsibility of the
parent/guardian to respond promptly to casting offers and availability checks.
5.2 Once the child performer has been confirmed or “penciled” for a role, the child must
keep the entire period available for that work. The parent/guardian must inform the agency
if the child is no longer available.
5.3 The agency reserves the right to cancel or change any confirmed work due to client
requirements, and the agency will inform the parent/guardian as soon as possible.
6. Fees and Commission
6.1 The agency charges a commission fee of 20% on all work secured for the child
performer. This fee will be deducted from the payment received from the client.
6.2 All payments will be made to the agency by the client, and the balance, after deduction
of the agency’s commission, will be transferred to the parent/guardian’s designated bank
account within 30-60 working days after receipt from the client.
6.3 It is the responsibility of the parent/guardian to ensure the agency has correct bank
details on file to avoid payment delays.
7. Performance Licenses (Scotland)
7.1 Where a performance license is required under the Children (Performances and
Activities) (Scotland) Regulations 2014, the agency will work with the parent/guardian to
obtain the necessary license from the relevant Scottish local authority (typically the local
council).
7.2 No work will be undertaken without a valid performance license where one is legally
required, as specified by the relevant local authority in Scotland.
8. Health, Safety, and Welfare
8.1 The agency will take all reasonable steps to ensure that clients provide a safe and
suitable working environment for child performers. The parent/guardian will be provided
with information about the working conditions before the child starts work.
8.2 The parent/guardian is responsible for the child’s welfare during the child’s
employment, ensuring their physical and emotional well-being at all times.
8.3 Any health or safety concerns during the child’s work should be immediately reported to
the agency and the client.
9. Professional Conduct
9.1 The child performer and parent/guardian are expected to act professionally and
responsibly during any work secured by the agency. This includes punctuality, cooperation
on set, and adherence to the production’s requirements.
9.2 The child performer is not allowed to share any confidential information, scripts, or
photos from the set or production on social media or any other platform unless explicitly
allowed by the client. Any breach of this rule may lead to termination of registration with
the agency.
10. Termination of Registration
10.1 The parent/guardian may terminate the child performer’s registration with the agency
by providing written notice. Termination can only take place once the child has completed
or been released from any pending work.
10.3 The agency reserves the right to terminate the child performer’s registration at any
time for failure to comply with these Terms and Conditions or for any behaviour that is
deemed unprofessional or inappropriate.
11. Data Protection (Scotland)
11.1 The agency will handle all personal information in compliance with the Data Protection
Act 1998, the UK General Data Protection Regulation (UK GDPR), and relevant Scottish data
protection laws.
11.2 The parent/guardian consents to the agency storing and processing the child
performer’s personal data for the purpose of securing work, including sharing necessary
details with clients for casting opportunities.
11.3 Personal and sensitive information will be kept secure and only shared where
necessary for work or legal purposes. Bank details will never be shared with third parties
outside the agency.
12. Variation of Terms
12.1 The agency reserves the right to amend these Terms and Conditions at any time. Any
changes will be communicated to the parent/guardian with one month’s notice.
12.2 If the parent/guardian does not agree with the updated Terms and Conditions, they
must notify the agency in writing within that one-month period, and the child’s registration
will be terminated following completion of any booked work.
